An Appeal to Mr Nikol Pashinyan, the People of Armenia and the International Community

Gagik Tsarukyan Must Be Released Immediately!

I am writing this open letter in my capacity as a journalist, author, photojournalist, and human rights defender.

Although I am of Armenian origin and a Swiss national, I am not a citizen of the Republic of Armenia and therefore do not have the right to vote in Armenia. For this reason, I did not support or endorse any political party during the electoral process. I followed the elections solely in my capacity as a journalist and an independent observer.

As a journalist and author who worked for many years as a correspondent at the United Nations, I am expressing the views set out here on the basis of my many years of professional experience, my observations and my commitment to human rights.

My sole reason for writing this letter is to sincerely express my deep concerns regarding the future of my country, Armenia.

From what I observed — and I can speak only about Yerevan — the elections of 7 June took place in a democratic, transparent and calm environment. The fact that the 18 political parties participating in the elections respected the results of the ballot box is an extremely important and valuable attitude for Armenian democracy.

Mr Nikol Pashinyan achieved significant success in these elections and, through the will of the people, earned the right to govern the country. The people of Armenia and the opposition respected this democratic will expressed at the ballot box.

However, democracy is not merely about winning elections. Democracy means respecting the rule of law, human rights, fundamental rights and freedoms, differing opinions and the existence of the opposition.

Unfortunately, serious concerns are now emerging that this electoral victory, instead of serving to strengthen democracy, may be turning into an instrument of pressure hanging over the opposition.

Today, Mr Pashinyan must unite rather than divide. He must not forget that he is the Prime Minister not only of those who voted for him, but of the entire Armenian people, and that he bears the responsibility of representing all citizens.

For Mr Pashinyan to work with the leaders of the 18 political parties that participated in the elections in a spirit of dialogue, mutual respect and harmony is one of the fundamental prerequisites for realising the vision of a strong, democratic Armenia that looks to the future with confidence.

Dividing society, engaging in confrontation, pursuing political score-settling, acting out of revenge and resentment, or disregarding any section of society brings no benefit to anyone or to any country. On the contrary, such approaches deepen social polarisation, undermine trust in democracy and damage the country’s future.

For days, I have been following through the press, with great sadness, concern and dismay, the measures taken against Mr Gagik Tsarukyan.

Mr Gagik Tsarukyan is the leader of a political party, a political figure who received approximately four per cent of the votes of the Armenian people, and also a well-known businessman. It is therefore of great importance that all judicial and administrative proceedings concerning him be conducted within the framework of the rule of law, the presumption of innocence and respect for human dignity.

I wish to emphasise in particular that no one can or should be declared guilty without a final court judgment. The presumption of innocence is one of the most fundamental and universal principles of law.

The images made public concerning the raid on Mr Tsarukyan’s home are extremely troubling and difficult to accept, both from Armenia’s perspective and in terms of the principles of international law and human rights.

From what I could see in the images published by the media, the treatment of Mr Tsarukyan was of a nature that deeply offended human dignity and raised serious concerns. Torture and inhuman or degrading treatment are strictly prohibited under international law.

At the same time, the calm and dignified attitude displayed by Mr Gagik Tsarukyan during his arrest was also striking. In my view, the fact that he was smiling in the images made public was an entirely human and meaningful reaction. This smile may be interpreted as a sign that he did not surrender to fear in the face of the measures taken against him and that he was expressing, silently but powerfully, the tragicomic dimension of what was happening.

Sometimes laughter is not merely an expression of happiness. Laughter is a form of peaceful resistance arising from within the human spirit against fear, pressure and injustice. In this sense, laughter is a revolutionary act.

Laughter is one of the deepest expressions of human sincerity. The ability to smile even in the most difficult moments shows that a person is preserving their dignity, inner freedom and hope. In my eyes, Mr Tsarukyan’s smile was also a powerful message that upheld human dignity in the face of events and silently conveyed a great deal.

We must not forget that Armenia is a member of the United Nations and a member state of the Council of Europe. It has also signed and ratified the European Convention on Human Rights. It therefore bears the responsibility of fulfilling its international obligations concerning the rule of law, the presumption of innocence, human dignity, and the right to respect for private life and the home.

These publicly reported images and practices raise serious questions regarding those international obligations and heighten concerns about possible human rights violations.

I believe that the political responsibility for these measures against Mr Gagik Tsarukyan lies with the current government and with Mr Nikol Pashinyan, who heads that government.

Mr Pashinyan,

Please reconsider the decisions taken concerning Mr Gagik Tsarukyan and the measures applied to him. Demonstrate once again that everyone is equal before the law and that no one may be subjected to different treatment because of their political views or opposition identity.

It is of great importance that these events be investigated by independent, impartial and transparent institutions, and that the law and human rights be applied equally to everyone.

I believe that one day the question of whether the measures taken against Mr Tsarukyan were lawful will be fully clarified before an independent and impartial judiciary. If his innocence is established, the injustices committed against him will also become visible to everyone. If anyone is responsible for unlawful practices, they too must be held accountable before justice.

International law and the rule of law stand above all else. The interests of Armenia and the Armenian people must be placed above all forms of political score-settling.

Resentment, hatred and revenge have never brought lasting success, democracy or social peace to any country.

It must not be forgotten that pressure can never be a lasting form of government. History has repeatedly shown that repressive practices harm not only those subjected to them, but, over time, those who impose them as well.

This open letter is not the product of any political score-settling, personal interest, or intention to support or target any particular political side.

My sole purpose is to share my concerns regarding Armenia’s democratic future, the rule of law, human rights, social peace and the common interests of our people.

This letter is a sincere appeal to Mr Nikol Pashinyan, the people of Armenia and the international community.

My appeal is for unity and solidarity to replace division, dialogue to replace confrontation, justice to replace political score-settling, and democracy and the rule of law to prevail over pressure.

The future of Armenia is our shared responsibility.

Today, more than ever, Armenia needs unity, justice, democracy, common sense and social peace.

Our country can achieve a strong, democratic, free and peaceful future only through mutual respect, social reconciliation, commitment to human rights and the equal application of the law to everyone.

ԲԱՑ ՆԱՄԱԿ

Կոչ՝ ուղղված պարոն Նիկոլ Փաշինյանին, Հայաստանի ժողովրդին և միջազգային հանրությանը «Գագիկ Ծառուկյանըպետք է անհապաղ ազատ արձակվի»

Այս բաց նամակը գրում եմ որպես լրագրող, գրող, ֆոտոլրագրող և մարդու իրավունքների պաշտպան։

Ես հայկական ծագում ունեցող, Շվեյցարիայի քաղաքացի, լրագրող, գրող, ֆոտոլրագրող և մարդու իրավունքներիպաշտպան եմ։ 

Սակայն Հայաստանի Հանրապետության քաղաքացի չեմ և Հայաստանում ընտրելու իրավունք չունեմ։ Այդ պատճառովընտրական գործընթացում չեմ աջակցել որևէ քաղաքական կուսակցության։

Ընտրություններին հետևել եմ բացառապես որպես լրագրող և անկախ դիտորդ։ Որպես լրագրող և գրող, որը երկարտարիներ աշխատել է ՄԱԿ-ում որպես թղթակից, այս նամակում արտահայտված մտքերը շարադրել եմ՝ հիմնվելով իմերկարամյա մասնագիտական փորձի, դիտարկումների և մարդու իրավունքներին իմ նվիրվածության վրա։

Այս նամակը գրելու միակ պատճառը Հայաստանի՝ իմ հայրենիքի ապագայի վերաբերյալ ունեցած խորմտահոգությունն անկեղծորեն արտահայտելն է։ Իմ դիտարկումների համաձայն՝ և կարող եմ խոսել միայն Երևանիմասին, հունիսի 7-ի ընտրություններն անցկացվել են ժողովրդավարական, թափանցիկ և խաղաղ մթնոլորտում։

Ընտրություններին մասնակցած 18 քաղաքական կուսակցությունների կողմից ընտրությունների արդյունքներինկատմամբ հարգանք ցուցաբերելը չափազանց կարևոր և արժեքավոր քայլ է Հայաստանի ժողովրդավարությանհամար։

Պարոն Նիկոլ Փաշինյանը այս ընտրություններում հասել է նշանակալի հաղթանակի և ժողովրդի կամքով ստացել էերկիրը ղեկավարելու մանդատը։ Ընտրությունների արդյունքում արտահայտված այս ժողովրդավարական կամքըհարգվել է թե՛ Հայաստանի ժողովրդի, թե՛ ընդդիմության կողմից։ Սակայն ժողովրդավարությունը միայնընտրություններում հաղթելը չէ։

Ժողովրդավարությունը նաև օրենքի գերակայության, մարդու իրավունքների, հիմնարար իրավունքների ևազատությունների, տարբեր կարծիքների, ինչպես նաև ընդդիմության գոյության նկատմամբ հարգանքն է։

Ցավոք, այսօր լուրջ մտահոգություններ են առաջանում, որ այս ընտրական հաղթանակը, ժողովրդավարություննամրապնդելու փոխարեն, վերածվում է ընդդիմության նկատմամբ ճնշման գործիքի։ Այսօր պարոն Փաշինյանը պետք էլինի ոչ թե պառակտող, այլ միավորող առաջնորդ։ Նա չպետք է մոռանա, որ վարչապետն է ոչ միայն իր օգտինքվեարկած քաղաքացիների, այլև ամբողջ Հայաստանի ժողովրդի, և պատասխանատվություն է կրում ներկայացնելուողջ հասարակությանը։ Պարոն Փաշինյանի կողմից ընտրություններին մասնակցած 18 քաղաքականկուսակցությունների ղեկավարների հետ երկխոսության, փոխադարձ հարգանքի և համագործակցության մթնոլորտումաշխատելը այն հիմնական նախապայմաններից է, որոնք անհրաժեշտ են ուժեղ, ժողովրդավարական և ապագայինվստահությամբ նայող Հայաստանի կերտման համար։

Պառակտել հասարակությունը, հակամարտություններ հրահրել, քաղաքական հաշվեհարդարի ճանապարհով գնալ, առաջնորդվել վրեժխնդրության և ատելության զգացումներով կամ անտեսել հասարակության որևէ հատվածի շահերնու իրավունքները՝ երբեք օգուտ չեն բերում ո՛չ որևէ անձի, ո՛չ էլ որևէ երկրի։ Ընդհակառակը, նման մոտեցումներըխորացնում են հասարակական բևեռացումը, խաթարում ժողովրդավարության նկատմամբ վստահությունը և վնասումերկրի ապագային։

Արդեն մի քանի օր է, ինչ զանգվածային լրատվամիջոցներից մեծ ցավով, մտահոգությամբ և զարմանքով հետևում եմպարոն Գագիկ Ծառուկյանի նկատմամբ իրականացվող գործողություններին։

Պարոն Գագիկ Ծառուկյանը քաղաքական կուսակցության առաջնորդ է, Հայաստանի ժողովրդի շուրջ 4 տոկոսիվստահության քվեն ստացած քաղաքական գործիչ և միաժամանակ ճանաչված գործարար։ Ուստի նրա նկատմամբցանկացած դատավարական կամ վարչական գործողություն պետք է իրականացվի օրենքի գերակայության, անմեղության կանխավարկածի և մարդու արժանապատվության նկատմամբ հարգանքի սկզբունքներիշրջանակներում։

Հատկապես ցանկանում եմ ընդգծել, որ ոչ ոք չի կարող և չպետք է մեղավոր ճանաչվի, քանի դեռ նրա նկատմամբ չկաօրինական ուժի մեջ մտած դատական վճիռ։ Անմեղության կանխավարկածը իրավունքի ամենահիմնարար ևհամընդհանուր սկզբունքներից մեկն է։

Պարոն Ծառուկյանի բնակարանում իրականացված խուզարկության վերաբերյալ հանրությանը հասանելի դարձածտեսանյութերը թե՛ Հայաստանի, թե՛ միջազգային իրավունքի և մարդու իրավունքների սկզբունքների տեսանկյունիցչափազանց մտահոգիչ և դժվար ընդունելի են։

Ինչպես երևում է մամուլում հրապարակված կադրերից, պարոն Ծառուկյանի նկատմամբ ցուցաբերված վերաբերմունքըխորապես վիրավորում է մարդու արժանապատվությունը և լուրջ մտահոգություններ է առաջացնում։ Խոշտանգումները, անմարդկային կամ նվաստացնող վերաբերմունքը միջազգային իրավունքով բացարձակապես արգելված են։

Միաժամանակ ուշադրության արժանի էր նաև այն հանգիստ և արժանապատիվ պահվածքը, որը պարոն ԳագիկԾառուկյանը ցուցաբերեց իր ձերբակալության ժամանակ։ Հանրությանը հասանելի դարձած կադրերում նրա ժպիտը, իմկարծիքով, չափազանց մարդկային և խորիմաստ արձագանք էր։ Այդ ժպիտը կարելի է մեկնաբանել որպես այն բանիվկայություն, որ նա չի տրվել վախին և լուռ, բայց ուժեղ կերպով արտահայտել է տեղի ունեցողի ողբերգական ումիաժամանակ աբսուրդային բնույթը։

Երբեմն ժպիտը միայն երջանկության արտահայտություն չէ։ Ժպիտը մարդու ներաշխարհից բխող խաղաղդիմադրության ձև է՝ ուղղված վախի, ճնշման և անարդարության դեմ։ Այդ իմաստով ժպտալը հեղափոխական արարք է։

Ժպիտը մարդու անկեղծության ամենախոր արտահայտություններից մեկն է։ Նույնիսկ ամենադժվար պահերին ժպտալկարողանալը նշանակում է պահպանել սեփական արժանապատվությունը, ներքին ազատությունն ու հույսը։ Իմ աչքումպարոն Ծառուկյանի ժպիտը հենց այդպիսի ուժեղ ուղերձ էր, որը լուռ կերպով շատ բան էր ասում և վկայում էր մարդուարժանապատվությունը պահպանելու մասին։

Չպետք է մոռանանք, որ Հայաստանը Միավորված ազգերի կազմակերպության անդամ պետություն է և Եվրոպայիխորհրդի անդամ։ Միևնույն ժամանակ այն ստորագրել և վավերացրել է Մարդու իրավունքների եվրոպականկոնվենցիան։ Հետևաբար Հայաստանը պարտավոր է կատարել օրենքի գերակայությանը, անմեղությանկանխավարկածին, մարդու արժանապատվությանը, ինչպես նաև անձնական կյանքի և բնակարանիանձեռնմխելիության իրավունքին վերաբերող իր միջազգային պարտավորությունները։

Հանրությանը ներկայացված այս կադրերն ու իրականացված գործողությունները լուրջ հարցեր են առաջացնում այդմիջազգային պարտավորությունների կատարման տեսանկյունից և ուժեղացնում են մարդու իրավունքների հնարավորխախտումների վերաբերյալ մտահոգությունները։

Կարծում եմ, որ պարոն Գագիկ Ծառուկյանի նկատմամբ իրականացված այս գործողությունների քաղաքականպատասխանատվությունը կրում են գործող կառավարությունը և դրա ղեկավար՝ վարչապետ Նիկոլ Փաշինյանը։

Պարոն Փաշինյան,

Խնդրում եմ վերանայեք պարոն Գագիկ Ծառուկյանի վերաբերյալ ընդունված որոշումները և նրա նկատմամբիրականացված գործողությունները։ Եվս մեկ անգամ ապացուցեք, որ օրենքի առաջ բոլորը հավասար են, և որ ոչ ոք չիկարող ենթարկվել տարբեր վերաբերմունքի՝ իր քաղաքական հայացքների կամ ընդդիմադիր դիրքորոշմանպատճառով։

Չափազանց կարևոր է, որպեսզի տեղի ունեցածը քննվի անկախ, անաչառ և թափանցիկ մարմինների կողմից, իսկօրենքն ու մարդու իրավունքները հավասարապես կիրառվեն բոլորի նկատմամբ։

Հավատում եմ, որ մի օր անկախ և անաչառ դատարանը լիովին կպարզի, թե արդյոք պարոն Ծառուկյանի նկատմամբիրականացված գործողությունները համապատասխանում էին օրենքին։ Եթե ապացուցվի նրա անմեղությունը, ապանրա նկատմամբ գործադրված անարդարությունները նույնպես ակնհայտ կդառնան բոլորի համար։ Իսկ եթե եղել ենօրենքին հակասող գործողություններ, ապա դրանց համար պատասխանատու անձինք նույնպես պետք էպատասխանատվություն կրեն արդարադատության առջև։

Միջազգային իրավունքն ու օրենքի գերակայությունը վեր են ամեն ինչից։ Հայաստանի և Հայաստանի ժողովրդի շահերըպետք է վեր դասվեն ցանկացած քաղաքական հաշվեհարդարից։

Ո՛չ ատելությունը, ո՛չ թշնամանքը և ո՛չ էլ վրեժխնդրության զգացումը երբևէ որևէ երկրի չեն բերել տևական հաջողություն, ժողովրդավարություն կամ հասարակական խաղաղություն։

Չպետք է մոռանալ, որ ճնշումը երբեք չի կարող դառնալ կառավարման կայուն ձև։ Պատմությունը բազմիցս ցույց է տվել, որ ճնշող գործելակերպը ժամանակի ընթացքում վնասում է ոչ միայն ճնշումների ենթարկվածներին, այլև հենց այդճնշումն իրականացնողներին։

Այս բաց նամակը որևէ քաղաքական հաշվեհարդարի, անձնական շահի կամ որևէ քաղաքական ուժի պաշտպանելուկամ թիրախավորելու մտադրության արդյունք չէ։

Իմ միակ նպատակն է կիսվել Հայաստանի ժողովրդավարական ապագայի, օրենքի գերակայության, մարդուիրավունքների, հասարակական խաղաղության և մեր ժողովրդի ընդհանուր շահերի վերաբերյալ ունեցածմտահոգություններով։

Այս նամակը անկեղծ կոչ է՝ ուղղված պարոն Նիկոլ Փաշինյանին, Հայաստանի ժողովրդին և միջազգային հանրությանը։

Իմ կոչն է, որ պառակտման փոխարեն գերիշխեն միասնությունն ու համերաշխությունը, հակամարտության փոխարեն՝երկխոսությունը, քաղաքական հաշվեհարդարի փոխարեն՝ արդարությունը, իսկ ճնշման փոխարեն՝ժողովրդավարությունն ու օրենքի գերակայությունը։

Հայաստանի ապագան մեր բոլորի ընդհանուր պատասխանատվությունն է։

Այսօր Հայաստանին առավել, քան երբևէ, անհրաժեշտ են միասնությունը, արդարությունը, ժողովրդավարությունը, ողջախոհությունը և հասարակական խաղաղությունը։

Մեր երկրի ուժեղ, ժողովրդավարական, ազատ և խաղաղ ապագան հնարավոր կլինի միայն փոխադարձ հարգանքի, հասարակական համերաշխության, մարդու իրավունքների նկատմամբ հավատարմության և օրենքի՝ բոլորինկատմամբ հավասար կիրառման շնորհիվ։

Appel à Monsieur Nikol Pachinian, au peuple arménien et à l’opinion publique internationale

Gagik Tsarukyan doit être libéré immédiatement !

Je rédige cette lettre ouverte en ma qualité de journaliste, écrivain, photojournaliste et défenseur des droits humains.

D’origine arménienne et de nationalité suisse, je ne suis Toutefois pas citoyen de la République d’Arménie et ne dispose pas du droit de vote en Arménie. C’est pourquoi je n’ai pris parti pour aucune formation politique durant le processus électoral. J’ai suivi les élections uniquement en ma qualité de journaliste et d’observateur indépendant.

En tant que journaliste et écrivain ayant travaillé durant de nombreuses années comme correspondant auprès des Nations Unies, je formule ici mes réflexions étayées sur ma longue expérience professionnelle, mes observations et mon attachement aux droits humains.

La seule raison qui me pousse à écrire cette lettre est d’exprimer avec sincérité les profondes inquiétudes que je ressens quant à l’avenir de mon pays, l’Arménie.

D’après ce que j’ai pu observer — et je ne peux parler que d’Erevan — les élections du 7 juin se sont déroulées dans un climat démocratique, transparent et calme. Le fait que les 18 partis politiques ayant participé aux élections aient respecté les résultats issus des urnes constitue une attitude extrêmement importante et précieuse pour la démocratie arménienne.

Monsieur Nikol Pachinian a remporté un succès important lors de ces élections et a acquis, par la volonté du peuple, le droit de gouverner le pays. Le peuple arménien et l’opposition ont respecté cette volonté démocratique exprimée dans les urnes.

Cependant, la démocratie ne consiste pas uniquement à gagner des élections. La démocratie signifie respecter l’État de droit, les droits humains, les droits et libertés fondamentaux, la diversité des opinions et l’existence de l’opposition.

Malheureusement, de sérieuses inquiétudes apparaissent aujourd’hui quant au risque que cette victoire électorale, au lieu de devenir un facteur de renforcement de la démocratie, ne se transforme en un instrument de pression suspendu au-dessus de l’opposition.

Aujourd’hui, Monsieur Pachinian doit être un rassembleur et non un facteur de division. Il ne doit pas oublier qu’il est le Premier ministre non seulement de celles et ceux qui ont voté pour lui, mais de l’ensemble du peuple arménien, et qu’il porte la responsabilité de représenter toute la population.

Le fait que Monsieur Pachinian travaille avec les dirigeants des 18 partis politiques ayant participé aux élections dans un esprit de dialogue, de respect mutuel et d’harmonie constitue l’une des conditions fondamentales pour réaliser le rêve d’une Arménie forte, démocratique et tournée avec confiance vers l’avenir.

Diviser, provoquer des affrontements, s’engager dans des règlements de comptes politiques, agir sous l’emprise de la vengeance et de la rancœur ou ignorer une partie de la société ne profite à personne ni à aucun pays. Au contraire, de telles approches accentuent la polarisation sociale, ébranlent la confiance dans la démocratie et nuisent à l’avenir du pays.

Depuis plusieurs jours, je suis dans les médias, avec une grande tristesse, inquiétude et consternation, les mesures prises à l’encontre de Monsieur Gagik Tsarukyan.

Monsieur Gagik Tsarukyan est le dirigeant d’un parti politique, une personnalité politique ainsi qu’un homme d’affaires reconnu ayant obtenu environ quatre pour cent des voix du peuple arménien,. Il est donc essentiel que toute procédure judiciaire ou administrative le concernant soit menée dans le respect de l’État de droit, de la présomption d’innocence et de la dignité humaine.

Je tiens à souligner tout particulièrement que nul ne peut ni ne doit être déclaré coupable en l’absence d’une décision judiciaire définitive. La présomption d’innocence est l’un des principes les plus fondamentaux et universels du droit.

Les images rendues publiques concernant la perquisition effectuée au domicile de Monsieur Tsarukyan sont extrêmement préoccupantes et difficilement acceptables, tant du point de vue de l’Arménie que des principes du droit international et des droits humains.

D’après ce que j’ai pu voir dans les images diffusées par la presse, le traitement infligé à Monsieur Tsarukyan est de nature à porter profondément atteinte à la dignité humaine et à susciter de graves inquiétudes. La torture ainsi que les traitements inhumains ou dégradants sont formellement interdits par le droit international.

Par ailleurs, l’attitude calme et digne adoptée par Monsieur Gagik Tsarukyan lors de son arrestation était également remarquable. Le fait qu’il souriedans les images rendues publiques constitue, à mes yeux, une réaction profondément humaine et significative. Ce sourire peut être interprété comme le signe qu’il ne s’est pas laissé gagner par la peur face aux mesures prises à son encontre et qu’il exprimait, silencieusement mais avec force, la dimension tragi-comique des événements.

Parfois, rire n’est pas seulement une expression de bonheur. Le rire est une forme de résistance pacifique qui s’élève du for intérieurde l’être humain face à la peur, à la pression et à l’injustice. En ce sens, rire est un acte révolutionnaire.

Le rire est l’une des expressions les plus profondes de la sincérité humaine. Pouvoir sourire, même dans les moments les plus difficiles, montre que l’être humain préserve sa dignité, sa liberté intérieure et son espoir. À mes yeux, le sourire de Monsieur Tsarukyan est également un message puissant, garant de la dignité humaine face aux événements et qui exprime silencieusement beaucoup de choses.

Nous ne devons pas oublier que l’Arménie est membre des Nations Unies et partie au Conseil de l’Europe. Elle a également signé et ratifié la Convention européenne des droits de l’homme. Elle a donc la responsabilité de respecter ses obligations internationales relatives à l’État de droit, à la présomption d’innocence, à la dignité humaine ainsi qu’au droit au respect de la vie privée et du domicile.

Les images et les pratiques rendues publiques soulèvent de sérieuses interrogations au regard de ces obligations internationales et renforcent les inquiétudes concernant d’éventuelles violations des droits humains.

Je considère que la responsabilité politique des mesures prises à l’encontre de Monsieur Gagik Tsarukyan incombe au gouvernement actuel et à Monsieur Nikol Pachinian, qui le dirige.

Je vous prie de réexaminer les décisions prises concernant Monsieur Gagik Tsarukyan ainsi que les mesures appliquées à son encontre. Montrez une nouvelle fois que toutes et tous sont égaux devant la loi et que nul ne peut faire l’objet d’un traitement différent en raison de ses opinions politiques ou de son identité d’opposant.

Il est essentiel que ces événements fassent l’objet d’une enquête menée par des institutions indépendantes, impartiales et transparentes, et que le droit ainsi que les droits humains soient appliqués de manière égale à toutes et à tous.

Je suis convaincu qu’un jour, la conformité au droit des mesures prises à l’encontre de Monsieur Tsarukyan sera établie en toute clarté devant une justice indépendante et impartiale. Si son innocence est démontrée, les injustices dont il a été victime apparaîtront également aux yeux de tous. S’il existe des responsables de pratiques contraires au droit, ils devront eux aussi répondre de leurs actes devant la justice.

Le droit international et l’État de droit sont au-dessus de toute autre considération. Les intérêts de l’Arménie et du peuple arménien doivent primer sur tout règlement de comptes politique.

La rancœur, la haine et le désir de vengeance n’ont jamais apporté à un pays un succès durable, la démocratie ou la paix sociale.

Il ne faut pas oublier que la pression ne peut jamais constituer un mode de gouvernement durable. L’histoire a démontré à maintes reprises que les pratiques répressives nuisent non seulement à celles et ceux qui les subissent, mais aussi, avec le temps, à celles et ceux qui les exercent.

Cette lettre ouverte n’est le produit d’aucun règlement de comptes politique, d’aucun intérêt personnel, ni d’une volonté de soutenir ou de prendre pour cible un camp politique particulier.

Mon seul objectif est de partager mes préoccupations concernant l’avenir démocratique de l’Arménie, l’État de droit, les droits humains, la paix sociale et les intérêts communs de notre peuple.

Cette lettre est un appel sincère adressé à Monsieur Nikol Pachinian, au peuple arménien et à l’opinion publique internationale.

Mon appel vise à ce que l’unité et la solidarité remplacent la division, le dialogue l’affrontement, la justice les règlements de comptes politiques, et que la démocratie ainsi que l’État de droit prévalent sur la pression.

L’avenir de l’Arménie relève de notre responsabilité commune.

Aujourd’hui plus que jamais, l’Arménie a besoin d’unité, de justice, de démocratie, de sagesse et de paix sociale.

Notre pays ne pourra parvenir à un avenir fort, démocratique, libre et pacifique qu'à force de respect mutuel, de consensus social, d'’attachement aux droits humains et à l’application égale du droit, pour toutes et tous.

Sayın Nikol Paşinyan’a, Ermenistan Halkına ve Uluslararası Kamuoyuna Çağrı

Bu açık mektubu bir gazeteci, yazar, foto muhabiri ve insan hakları savunucusu olarak kaleme alıyorum.

Ben, Ermeni kökenli, İsviçre vatandaşı bir gazeteci, yazar, foto muhabiri ve insan hakları savunucusuyum. Ancak Ermenistan Cumhuriyeti vatandaşı değilim ve Ermenistan’da oy kullanma hakkına sahip değilim. Bu nedenle seçim sürecinde herhangi bir siyasi partinin yanında yer almadım. Seçimleri yalnızca bir gazeteci ve bağımsız gözlemci olarak takip ettim.

Yıllarca Birleşmiş Milletler nezdinde muhabirlik yapmış bir gazeteci ve yazar olarak, burada dile getirdiğim düşünceleri uzun yıllara dayanan mesleki deneyimlerimden, gözlemlerimden ve insan haklarına olan bağlılığımdan hareketle kaleme alıyorum.

Bu mektubu yazmamın tek nedeni, ülkem Ermenistan’ın geleceğine ilişkin duyduğum derin kaygıları samimiyetle ifade etmektir.

Gözlemlediğim kadarıyla — yalnızca Yerevan için konuşabilirim — 7 Haziran seçimleri demokratik, şeffaf ve sakin bir ortamda gerçekleşmiştir. Seçimlere katılan 18 siyasi partinin sandıktan çıkan sonuçlara saygı göstermesi, Ermenistan demokrasisi açısından son derece önemli ve değerli bir tutumdur.

Sayın Nikol Paşinyan, bu seçimlerde önemli bir başarı elde etmiş ve halkın iradesiyle ülkeyi yönetme hakkını kazanmıştır. Sandıktan çıkan bu demokratik iradeye Ermenistan halkı ve muhalefet saygı göstermiştir.

Ancak demokrasi yalnızca seçim kazanmak değildir. Demokrasi; hukukun üstünlüğüne, insan haklarına, temel hak ve özgürlüklere, farklı düşüncelere ve muhalefetin varlığına saygı göstermektir.

Ne yazık ki bugün bu seçim zaferinin, demokrasiyi güçlendiren bir unsur olmak yerine, muhalefetin üzerinde sallanan bir baskı aracına dönüşmekte olduğu yönünde ciddi kaygılar oluşmaktadır.

Sayın Paşinyan bugün ayrıştırıcı değil, birleştirici olmalıdır. Yalnızca kendisine oy verenlerin değil, bütün Ermenistan halkının Başbakanı olduğunu ve tüm halkı temsil etme sorumluluğu taşıdığını unutmamalıdır.

Sayın Paşinyan’ın seçimlere katılan 18 siyasi partinin liderleriyle diyalog, karşılıklı saygı ve uyum içinde çalışması; güçlü, demokratik ve geleceğe güvenle bakan bir Ermenistan hayalinin gerçekleşebilmesinin temel ön koşullarından biridir.

Ayrıştırmak, çatışmak, siyasi hesaplaşmalara yönelmek, intikam ve kin duygularıyla hareket etmek veya toplumun herhangi bir kesimini yok saymak hiç kimseye ve hiçbir ülkeye kazanç sağlamaz. Aksine, bu tür yaklaşımlar toplumsal kutuplaşmayı derinleştirir, demokrasiye duyulan güveni zedeler ve ülkenin geleceğine zarar verir.

Günlerdir basından Sayın Gagik Tsarukyan’a yönelik uygulamaları büyük bir üzüntü, endişe ve ibretle takip ediyorum.

Sayın Gagik Tsarukyan, bir siyasi partinin lideri, Ermenistan halkının yaklaşık yüzde dördünün oyunu almış siyasi bir kişilik ve aynı zamanda tanınmış bir iş insanıdır. Bu nedenle kendisine yönelik her türlü adli ve idari işlemin hukukun üstünlüğü, masumiyet karinesi ve insan onuruna saygı ilkeleri çerçevesinde yürütülmesi büyük önem taşımaktadır.

Özellikle belirtmek isterim ki hiç kimse, hakkında kesinleşmiş bir mahkeme kararı bulunmadan suçlu ilan edilemez ve edilmemelidir. Masumiyet karinesi, hukukun en temel ve evrensel ilkelerinden biridir.

Sayın Tsarukyan’ın evine gerçekleştirilen baskına ilişkin kamuoyuna yansıyan görüntüler, hem Ermenistan açısından hem de uluslararası hukuk ve insan hakları ilkeleri bakımından son derece kaygı verici ve kabul edilmesi güç görüntülerdir.

Basına yansıyan görüntülerde gördüğüm kadarıyla Sayın Tsarukyan’a yönelik muamele, insan onurunu derinden inciten ve ciddi kaygılar uyandıran niteliktedir. İşkence, insanlık dışı veya aşağılayıcı muamele uluslararası hukuk tarafından kesin biçimde yasaklanmıştır.

Bununla birlikte, Sayın Gagik Tsarukyan’ın gözaltına alınması sırasında sergilediği sakin ve vakur tavır da dikkat çekiciydi. Kamuoyuna yansıyan görüntülerde gülümsüyor olması, bana göre son derece insani ve anlamlı bir tepkiydi. Bu gülümseme, kendisine yönelik uygulamalar karşısında korkuya teslim olmadığının ve yaşananların trajikomik yönünü sessiz fakat güçlü bir biçimde ifade ettiğinin göstergesi olarak yorumlanabilir.

Bazen gülmek yalnızca mutluluğun bir ifadesi değildir. Gülmek; korkuya, baskıya ve haksızlığa karşı insanın iç dünyasından yükselen barışçıl bir direnç biçimidir. Bu anlamda gülmek devrimci bir eylemdir.

Gülmek, insanın samimiyetinin en derin ifadelerinden biridir. En zor anlarda bile gülümseyebilmek; insanın onurunu, iç özgürlüğünü ve umudunu koruduğunu gösterir. Sayın Tsarukyan’ın gülümsemesi de benim gözümde, yaşananlar karşısında insan onurunu koruyan ve sessizce çok şey anlatan güçlü bir mesajdı.

Unutmamalıyız ki Ermenistan, Birleşmiş Milletler üyesi ve Avrupa Konseyi’ne taraf bir devlettir. Aynı zamanda Avrupa İnsan Hakları Sözleşmesi’ni imzalamış ve onaylamış bir ülkedir. Dolayısıyla hukukun üstünlüğüne, masumiyet karinesine, insan onuruna, özel hayata ve konuta saygı hakkına ilişkin uluslararası yükümlülüklerini yerine getirme sorumluluğu taşımaktadır.

Kamuoyuna yansıyan bu görüntüler ve uygulamalar, söz konusu uluslararası yükümlülükler bakımından ciddi soru işaretleri doğurmakta ve olası hak ihlallerine ilişkin kaygıları artırmaktadır.

Sayın Gagik Tsarukyan’a yönelik bu uygulamaların siyasi sorumluluğunun mevcut hükümete ve hükümetin başındaki Sayın Nikol Paşinyan’a ait olduğunu düşünüyorum.

Sayın Paşinyan,

Lütfen Sayın Gagik Tsarukyan hakkında alınan kararları ve kendisine yönelik uygulamaları yeniden gözden geçirin. Hukuk önünde herkesin eşit olduğunu ve hiç kimsenin siyasi görüşleri ya da muhalif kimliği nedeniyle farklı bir muameleye maruz bırakılamayacağını bir kez daha gösterin.

Bu yaşananların bağımsız, tarafsız ve şeffaf kurumlar tarafından araştırılması; hukukun ve insan haklarının herkes için eşit şekilde uygulanması büyük önem taşımaktadır.

İnanıyorum ki bir gün Sayın Tsarukyan’a yönelik bu uygulamaların hukuka uygun olup olmadığı bağımsız ve tarafsız yargı önünde bütün açıklığıyla ortaya çıkacaktır. Suçsuzluğu kanıtlandığı takdirde kendisine yapılan haksızlıklar da herkes tarafından görülecektir. Varsa hukuka aykırı uygulamalardan sorumlu olanların da adalet önünde hesap vermesi gerekecektir.

Uluslararası hukuk ve hukukun üstünlüğü her şeyin üzerindedir. Ermenistan’ın ve Ermenistan halkının çıkarları her türlü siyasi hesaplaşmanın önünde tutulmalıdır.

Kin, nefret ve intikam duyguları hiçbir zaman bir ülkeye kalıcı başarı, demokrasi veya toplumsal barış getirmemiştir.

Unutulmamalıdır ki baskı hiçbir zaman kalıcı bir yönetim biçimi olamaz. Tarih, baskıcı uygulamaların yalnızca baskıya maruz kalanlara değil, zaman içinde bu baskıyı uygulayanlara da zarar verdiğini defalarca göstermiştir.

Bu açık mektup herhangi bir siyasi hesaplaşmanın, kişisel çıkarın ya da belirli bir siyasi tarafı destekleme veya hedef alma düşüncesinin ürünü değildir.

Tek amacım, Ermenistan’ın demokratik geleceğine, hukukun üstünlüğüne, insan haklarına, toplumsal barışına ve halkımızın ortak çıkarlarına ilişkin duyduğum kaygıları paylaşmaktır.

Bu mektup; Sayın Nikol Paşinyan’a, Ermenistan halkına ve uluslararası kamuoyuna yönelik samimi bir çağrıdır.

Çağrım; ayrışmanın yerine birlik ve dayanışmanın, çatışmanın yerine diyaloğun, siyasi hesaplaşmaların yerine adaletin, baskının yerine demokrasinin ve hukukun üstünlüğünün hâkim olmasıdır.

Ermenistan’ın geleceği hepimizin ortak sorumluluğudur.

Ermenistan’ın bugün her zamankinden daha fazla birliğe, adalete, demokrasiye, sağduyuya ve toplumsal barışa ihtiyacı vardır.

Ülkemizin güçlü, demokratik, özgür ve barış içinde bir geleceğe ulaşabilmesi ancak karşılıklı saygı, toplumsal uzlaşma, insan haklarına bağlılık ve hukukun herkes için eşit biçimde uygulanmasıyla mümkün olacaktır.
